Terms of Service

These terms are a contract between you and TheColdDM (“we”, “us”) governing your use of the website at thecolddm.comand the services available through it (the “Service”). By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.

1. The Service

TheColdDM accepts a public LinkedIn profile URL plus your goal and bio, scrapes the target’s recent public posts, and generates three personalized cold-DM variants. We then send a follow-up email seven days later asking whether the DM got a reply; the resulting data improves our prompts over time.

2. Account and eligibility

• You must be at least 18 years old.
• You agree to provide accurate information at signup and keep it up to date.
• You are responsible for the security of your account credentials and for all activity under your account.
• We may suspend or terminate accounts that violate these terms, abuse the free tier, or appear to be operated by bots or fraudulent actors.

3. Acceptable use

You agree not to use the Service to:

• Send unsolicited bulk messages (spam) in violation of applicable anti-spam laws (DPDP Act, GDPR, CAN-SPAM, CASL).
• Harass, threaten, defame, or discriminate against any person.
• Generate DMs targeting minors, or DMs of a sexual, hateful, or violent nature.
• Impersonate any individual or organisation.
• Scrape or process profiles in violation of LinkedIn’s User Agreement or other platform terms.
• Resell, sublicense, or white-label the Service without our written permission.
• Reverse-engineer the Service, bypass rate limits, or attempt to extract our prompt templates or model configurations.
• Use automated tools to create multiple free-tier accounts in order to circumvent the lifetime free-tier limit.

Violations may result in immediate suspension and forfeiture of any unused paid balance.

4. Pricing and plans

• Free tier — three lifetime DM generations per account. Not three per month; three total. We reserve the right to adjust the free-tier quota for new signups.
• Starter (₹499 / month) — 100 generations per calendar month.
• Pro (₹1,499 / month) — 500 generations per month plus team templates and CRM export.
• Agency (₹4,999 / month) — 2,000 generations per month plus API access.

All prices are in Indian Rupees (INR) and exclude any taxes that may apply (GST is added at checkout for Indian customers). Payments are processed by Razorpay; we do not store your card details.

5. Renewals, cancellation, and refunds

• Paid plans auto-renew at the end of each billing period unless you cancel from the dashboard before the period ends.
• You can cancel any time. Cancellation takes effect at the end of the current billing period; you keep access until then.
• Refund policy — we offer refunds within seven (7) days of an initial paid purchase if the Service has been used to generate fewer than ten (10) DMs in that period. After the seven-day window or after that threshold is reached, payments are non-refundable. Email support@thecolddm.com with your account email to request a refund.
• Quotas reset monthly on each billing anniversary; unused generations do not roll over.

6. Intellectual property

• Your content — you retain ownership of the goal, bio, and any other inputs you provide. You also own the DM text generated for your account; you may use it however you like, including for commercial outreach.
• Our content — the Service, including its prompts, models, code, branding, and aggregate reply-rate data, is owned by us and protected under applicable law.
• Feedback — if you send us suggestions, you grant us a perpetual, royalty-free licence to use them in the Service.

7. Reply-rate data

When you respond to the 7-day reply-prompt email, you grant us permission to retain that signal and use it in aggregated, de-identified form to improve generation quality for all users. We do not share the content of your DMs or your contacts’ identities with anyone.

8. Third-party platforms

TheColdDM helps you draft messages, but you are responsible for sending them through LinkedIn, email, or whichever platform you choose. Your use of those platforms is governed by their own terms. We are not responsible for account restrictions, bans, or other consequences imposed by those platforms based on your sending behaviour.

9. Service availability

The Service is provided on an “as is” and “as available” basis. We aim for high uptime but do not guarantee an uninterrupted Service. Scheduled maintenance, third-party outages (Vercel, Supabase, Apify, LLM providers, Razorpay, Resend), or force majeure events may cause temporary disruption.

10. No guarantee of replies

TheColdDM increases the quality of cold DMs but does not guarantee any specific reply rate, conversion, or business outcome. Reply rates depend on factors outside our control: your offering, your contact list, your timing, and platform-specific factors.

11. Disclaimer of warranties

Except as required by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising from or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) ₹1,000. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption.

13. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, or damages (including reasonable legal fees) arising from (a) your breach of these terms, (b) DMs you send that violate applicable law, or (c) misuse of the Service.

14. Termination

You may close your account at any time. We may suspend or terminate your account for breach of these terms, fraudulent activity, or extended non-payment. On termination, your data is deleted per the Privacy Policy.

15. Changes to these terms

We may update these terms as the Service evolves. Material changes will be announced by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance.

16. Governing law and jurisdiction

These terms are governed by the laws of India. Disputes will be resolved in the courts of competent jurisdiction in India, unless applicable consumer-protection law in your country provides otherwise.
